Default having been made in the payment of the debts and obligations secured by a certain Deed of Trust executed the 22nd day of October, 2008 by Wilson C. Boiseau, Jr. and wife, Patsy C. Boiseau, to John P. This sale will be made subject to taxes for the year 2017 and subsequent years, 2017 and 2018 Lewis County solid waste assessments, all existing highway, roadway and utility easements; all matters of record pertaining to the property, including any prior liens; applicable building and zoning regulations; such state of facts as an accurate survey would disclose; any unpaid taxes and mechanics’ and material men’s liens.  The owners of the indebtedness have conducted a supplemental search on the property which reflected no state or federal tax liens. 

Other interested parties: (1) the heirs of William C. Boiseau., Jr. and Patsy C. Boiseau, and (2) Discover Bank, holder of a judgment lien of record in Book 163, Page 724 of the Register’s Office of Lewis County, Tennessee.

The property will be sold in its “as is” condition without warranties of fitness or title.

The right is reserved to adjourn the day of the sale to another day and time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day, time, and place of sale set forth above.

The failure of the high bidder to pay the purchase price and close the sale shall, at the option of the Trustee, or his agent, be cause for rejection of the bid, and, if the bid is rejected, the Trustee, or his agent, shall have the option of making the sale to the next highest bidder who is ready, willing, and able to comply with the terms thereof.  The proceeds derived from the sale of the property will be applied as provided for in the deed of trust which is made a part hereof as if copied verbatim herein.

All right and equity of redemption, Statutory and otherwise, homestead and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
