TRUSTEE’S SALE NOTICE

WHEREAS, on the 12th day of December, 2007, by deed of trust recorded in the Register’s Office of Lewis County, Tennessee, in Record Book 98, page 808, Joyce Marlene Grimes, conveyed to William E. Bates, Trustee, the hereinafter described real estate to secure the payment of a note therein described; and

WHEREAS, default has been made in payment of said indebtedness and other provisions of the deed of trust have been violated, and the holder of said indebtedness has directed the Trustee to foreclose the deed of trust in accordance with the terms thereof; the public is, therefore, hereby notified that the undersigned Trustee will sell the hereinafter described real estate at public auction to the highest and best bidder for cash, WEDNESDAY, MAY 14, 2014, AT 10:00 A.M. AT THE EAST DOOR OF THE COURT HOUSE IN HOHENWALD, LEWIS COUNTY, TENNESSEE

The property to be sold is located in Lewis County, Tennessee, and is more particularly described as follows:

Being and lying in the Third (3rd) Civil District of Lewis County, Tennessee, and being more particularly described as follows, to-wit:

TRACT NO. ONE: Beginning on a stake on the northwest corner of the land conveyed to Evelyn A. Tatum by deed of C.E. Anderson et ux., dated April 9, 1974, of record in Deed Book A-7, Page 209, Register’s Office of Lewis County, Tennessee, and running thence north 87-½ degrees west 90 feet; thence south 2-½ degrees west 195 feet; thence south 87-½ degrees east 90 feet to the southwest corner of said lot belonging to Evelyn A. Harrison, formerly Evelyn A. Tatum; thence with the west boundary of same north 2-½ degrees east 195 feet to the point of beginning.

TRACT NO. TWO: Beginning at a point 165 feet west of the beginning point in the legal description of the Evelyn A. Tatum property (Deed Book A-7, Page 209) on Tatum’s north boundary and continuing on said boundary 15 feet to the northwest corner of the Tatum lot; thence following the west boundary of the Tatum lot south 2-½ degrees west 195 feet to a stake; continuing on the Tatum southern boundary thence south 87-½ degrees east 15 feet; thence north 2-½ degrees east 195 feet to the point of beginning.

Being the westerly 15 foot section of the Tatum lot, being Lot No. 7.01 of the West Linden section of the Third Civil District which by this deed is transferred to the adjoin Lot No. 7.02.

Being the same property conveyed to William B. Grimes and wife, Joyce M. Grimes, by deed of Lewis M. Harrison dated November 30, 1989, of record in Deed Book A-48, Page 135, in the Register’s Office of Lewis County, Tennessee. William B. Grimes is now deceased and the said Joyce M. Grimes is the owner of said property as the surviving tenant by the entirety. Joyce M. Grimes is one and the same person and is now known as Joyce M. Martin.

This property is an improved tract identified as tax map 36M, group G, parcel 7.02, in the office of the Assessor of Property of Lewis County, Tennessee. The street address of the above-described property is believed to be 653 Anderson Lane, Hohenwald, Tennessee; but such address is not part of the legal description of the property sold herein, and in the event of any discrepancy, the legal description herein shall control.

Pursuant to T.C.A. 35-5-104, other parties that may have an interest in the tract of land herein described are the following:

Lewis County Trustee through unpaid County taxes for 2013 assessed as tax map 36M, group G, parcel 7.02, in the amount of $278.10, plus penalty & interest.

City of Hohenwald through unpaid City taxes for 2013 assessed as tax map 36M, group G, parcel 7.02, in the amount of $230.13, plus penalty & interest.

Lewis County Clerk & Master through unpaid City & County taxes for 2012 assessed as tax map 36M, group G, parcel 7.02, in the amount of $458.08, plus penalty & interest.

Lewis County Solid Waste Department through unpaid solid waste fees assessed as tax map 36M, group G, parcel 7.02, for 2013/14 in the amount of $94.00, plus penalty & interest; and for 2012/13 in the amount of $154.00.

The sale will be made free from the equity of redemption, homestead, dower and all other rights and exemptions, which were expressly waived under said deed of trust.

Trustee will convey all his right, title and interest, but without warranties of title. The sale will be made subject to any and all encumbrances, including but not limited to unpaid taxes; and I will sell and convey as Trustee and not otherwise.

The sale held pursuant to this Notice may be rescinded at the Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.
