A routine traffic stop for failure to stop at a stop sign resulted in two being charged with Methamphetamine, marijuana, suboxone and drug paraphernalia.
On March 17, 2020, Lewis County Sheriff Deputy Cody Atkinson noticed a vehicle, driven by Lucinda Kilpatrick, fail to stop at the stop sign on Ski Street. The vehicle pulled over at Piney Baptist Church on Piney Creek Road where Deputy Atkinson questioned her as to why she failed to stop. She stated the vehicle had been sitting a while and the brakes were not working properly. Kilpatrick could not provide the car registration or insurance documentations.
Deputy Atkinson asked Kilpatrick and her passenger, Gwendolyn Shirley if there was anything illegal in the vehicle to which they stated there should not be. He then asked the driver for consent to search the vehicle at which time she stated she prefer he did not. He stated he could deploy his K-9 for an open air sniff of the vehicle.
Ms. Kilpatrick then handed Deputy Atkinson a bracelet that had been used for smoking marijuana. He asked them to exit the vehicle and step back to the trailer they were pulling. He then searched Shirley’s pocket without finding anything and asked her to remove a dog which was in the vehicle.
On his way to his patrol car to get gloves, Deputy Atkinson noticed Shirley with her hands in a bag in the front seat. When searching her pockets again, the deputy discovered a syringe loaded to 20 units of methamphetamine in her jacket pocket. One Alprazolam and one unloaded syringe was found in her purse.
A blue bag in the passenger side floor contained 5.63 grams of marijuana, a metal cigarette used to smoke marijuana and a small marijuana cigarette.
Deputy Trevor Osborne assisted in the search and found four unloaded syringes with residue, one straw with residue, two glass pipes, one broken and one with residue, one small spoon, two needles, one loaded to 100 units of methamphetamine and one loaded to 30 units.
Deputy Atkinson read Miranda rights to both individuals and Deputies Todd Webb and Osborne transported both to Lewis County Jail.
Kilpatrick was charged with methamphetamine manufacture, deliver, sell, possess, simple possession schedule VI (marijuana), simple possession schedule III suboxone and drug paraphernalia. Shirley was charged with methamphetamine manufac-ture, deliver, sell, possess, simple possession schedule IV (Alprazolam), and unlawful drug paraphernalia.
