NOTICE OF TRUSTEE'S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated March 1, 2022, and the Deed of Trust of even date securing the same, recorded March 9, 2022, in Book No. 243, at Page 800, in Office of the Register of Deeds for Lewis County, Tennessee, executed by Michael Wayne Lopp and Kera Nicole Lopp, conveying certain property therein described to William H Hilton III as Trustee for Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for loanDepot.com, LLC, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by NewRez LLC d/b/a Shellpoint Mortgage Servicing.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by NewRez LLC d/b/a Shellpoint Mortgage Servicing, will, on January 15, 2025 on or about 2:00 PM, at the Lewis County Courthouse 110 North Park Street, Hohenwald, TN 38462, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Lewis County, Tennessee, and being more particularly described as follows:

BEING AND LYING IN THE 4TH CIVIL DISTRICT OF LEWIS COUNTY, TENNESSEE AND LYING WEST OF EAGLET ROAD AND EAST OF EAGLE RIDGE ROAD, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT AN IRON PIN FOUND; SAID IRON PIN FOUND BEING THE NORTHWEST CORNER OF THE TRACT BEING DESCRIBED, THE NORTHEAST CORNER OF TIMOTHY WATKINS, AND THE SOUTH BOUNDARY OF ANTHONY AND HEIDI KNOPP TRUSTEES; THENCE WITH KNOPP TRUSTEES, SOUTH 86 DEGREES 18 MINUTES 19 SECONDS E, FOR A DISTANCE OF 217.88 FEET TO A 14 INCH HICKORY; THENCE SOUTH 80 DEGREES 37 MINUTES 02 SECONDS E, FOR A DISTANCE OF 192.67 FEET TO A IRON PIN SET; SAID IRON PIN SET BEING THE NORTHEAST CORNER OF THE TRACT BEING DESCRIBED; THENCE LEAVING KNOPP TRUSTEES WITH A NEW RUBERT DIVISION LINE, SOUTH 30 DEGREES 36 MINUTES 45 SECONDS WEST, FOR A DISTANCE OF 402.79 FEET TO AN IRON PIN FOUND; SAID IRON PIN FOUND BEING THE NORTHWEST CORNER OF GREGORY HUGHES; THENCE LEAVING SAID DIVISION LINE WITH HUGHES. SOUTH 30 DEGREES 36 MINUTES 45 SECONDS, WEST FOR A DISTANCE OF 693.91 FEET TO A IRON PIN FOUND; SAID IRON PIN FOUND BEING THE SOUTHEAST COMER OF THE TRACT BEING DESCRIBED, AND THE EAST BOUNDARY OF WAYNE LOPP ETUX; THENCE WITH LOPP, NORTH 18 DEGREES 44 MINUTES 43 SECONDS WEST, FOR A DISTANCE OF 497.90 FEET TO A IRON PIN FOUND; SAID IRON PIN FOUND BEING THE SOUTHWEST CORNER OF THE TRACT BEING DESCRIBED, THE NORTHEAST CORNER OF LOPP, AND THE EAST BOUNDARY OF TIMOTHY WATKINS; THENCE WITH WATKINS, NORTH 30 DEGREES 59 MINUTES 08 SECONDS EAST, FOR A DISTANCE OF 604.02 FEET TO THE POINT OF BEGINNING AND CONTAINING 7.39 ACRES AS SURVEYED BY KENNETH CARROLL, RLS TENNESSEE LICENSE NUMBER 1335, MAY 29, 2019.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above- referenced property:

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the trustee hereby announces that the sale will be postponed and that notices of said postponement for inclement weather will be mailed to interested parties of record.
